Measures for the use and management of Shanghai's service industry development guidance funds

Chapter 1  General Provisions

Article 1 (Purpose and basis)

In accordance with the overall requirements of the city to accelerate the construction of "five centers", we will further consolidate and give full play to the main role of the service economy in the national economic and social development, comprehensively improve the overall quality and energy level of the service industry, and in order to give full play to the guiding and driving role of fiscal funds, improve the city's service industry development environment, guide social funds to increase investment in the service industry, and further improve and standardize the Shanghai service industry development guidance funds (hereinafter referred to as "guidance funds") )The use and management of these measures shall be formulated in accordance with the spirit of relevant national documents.

Article 2 (Source of Funds)

The guidance funds are arranged by the local fiscal budget and are specifically used for subsidy funds for the development of the city's service industry.

Article 3 (Support object)

The target of guiding financial support is legal persons and non-legal person organizations (except branches) established in this city in accordance with the law.The project unit should have a reasonable economic scale, have a good credit record, and have no illegal and irregular behaviors.

Article 4 (Management and Promotion Department)

The evaluation team is formed by the Municipal Development and Reform Commission, the Municipal Economic and Information Technology Commission, the Municipal Commerce Commission, the Municipal Finance Bureau and other departments, which are responsible for guiding the application and acceptance, evaluation and management, review and approval, supervision and inspection of funds.The office of the review group is located in the Municipal Development and Reform Commission.

The relevant departments of each district are responsible for the management of the district’s guidance fund project database and conduct preliminary review of the applied projects;Responsible for guiding the on-site and post-event supervision of funds, and promoting the implementation and acceptance of specific projects.

The municipal industry authorities are responsible for recommending major service industry projects in the industry that have a demonstration and leading role to the review team, and cooperating with each district to do a good job in the on-site and post-level supervision of funds.


Chapter 2  Scope of use and support

Article 5 (Scope of Use)

Guided funds are mainly used to support project construction, business development, major issues research in weak links, key areas, key areas and emerging industries in the development of the service industry, cultivate "new technologies, new business forms, new models, and new industries" in the service industry, and promote the internationalization, marketization, socialization and scale of the service industry.Mainly used in the following aspects:

(1) Support service industry projects in key areas specified in the "13th Five-Year Plan for the Development of Service Industry in Shanghai" (Hufufa [2016] No. 65) and the "Outline of Innovation and Development of Service Industry (2017-2025)" (Development and Reform Plan [2017] No. 1116).

(2) Support the service industry projects in key areas specified in the "Implementation Opinions of the Shanghai Municipal People's Government on Implementing the Guiding Opinions of the State Council on Accelerating the Development of Productive Service Industry and Promoting the Adjustment and Upgrading of Industrial Structure" (Hufufa [2015] No. 27).

(3) Support service industry projects in key areas specified in the "Several Opinions of the Shanghai Municipal People's Government on Promoting the Development of Life Service Industry in the City" (Hufufa [2014] No. 59).

(4) Support key service industry projects in the national comprehensive reform pilot area of ​​the service industry, the national mass entrepreneurship and innovation demonstration base, the national service industry demonstration park and the city's service industry innovation and development demonstration zone.

(5) Support the research on major strategies, major policies and major issues that promote the development of the city’s service industry.

(6) Support the construction of various service industry parks with demonstration and leading roles, and provide funding for the planning demonstration of their core regional development strategies, industrial development, functional positioning, etc.

(7) Support the development of service trade, service outsourcing, and cultural and creative industries.Specific support measures will be formulated separately.

(8) Other matters that need support are approved by the municipal government.

Article 6 (Support method)

Guide funds to adopt classified support.

(1) Major demonstration projects: Projects with a total investment of more than 30 million yuan (including) and have an important demonstration and driving role in the development of the city's service industry. They have the characteristics of advanced technology and innovative model, and will be supported by guidance funds at the municipal and district levels.

(2) Key projects: Projects with a total investment of 10 million yuan (inclusive) or above will be supported by guidance funds at the municipal and district levels.

(3) General projects: Projects with a total investment of less than 10 million yuan shall be supported by district-level guidance funds.

The total project investment refers to the project investment amount approved by the intermediary agency entrusted by the review group.

The support of municipal guidance funds is arranged and used by free funding, and is mainly used for equipment purchase and installation, software development, technology transfer, personnel training, system integration, design consultation, R&D testing, qualification certification, etc.

Explore the fund-based operation and management model of guiding funds, combine the investment of market funds such as venture capital to enterprises or projects, appropriately simplify the review process, study support methods such as follow-up investment, and further amplify the leading and driving role of fiscal fund support in the development of the service industry.

Article 7 (Supporting standards)

For major demonstration projects, the amount of municipal guidance fund support shall not exceed 6 million yuan in principle.Among them, for major functional service industry projects in the city that need to break the support ceiling, the review team will study and determine the support amount.

For key projects, the maximum support ratio of municipal guidance funds shall not exceed 20% of the total investment of the project, and the amount of support shall not exceed 3 million yuan.

Article 8 (district-level support)

In principle, the districts of major demonstration projects and key project enterprises that have obtained municipal guidance funds shall be located at no less than the municipal support 1. ∶1and funding will be arranged to support;Jinshan District, Fengxian District and Chongming District can be supported by no less than the municipal level. ∶0.5Funds are arranged to support the proportion.

Each district should formulate relevant regulations on the management and use of district-level guidance funds and provide support for service industry projects with a total investment of less than 10 million yuan.


Chapter 3  Project application and review

Article 9 (Project library management)

Each district should establish a project database for guiding fund budget management (hereinafter referred to as the "Project Database"), and include the applied projects in the project database after evaluation, and track, manage and promote the implementation of the projects included in the project database.

Article 10 (Preliminary review and forwarding)

The relevant departments of each district shall be responsible for the preliminary review of projects that have been included in the project database in accordance with these Measures, and entrust intermediary agencies to conduct preliminary screening of application materials through expert review and other methods, and strictly control them.Projects that have been arranged to support by municipal fiscal funds will not be accepted.

For major demonstration and key projects approved by each district in the preliminary review, relevant departments of each district submit guidance funds to the review group office in two installments before March 31 and August 15 each year, and provide the following main attachments:

(1) Summary form of guidance fund application.

(2) The preliminary review conclusion of each project.

(3) Application form for each project and related attachment materials.

Relevant departments of each district are responsible for the compliance and legality of the submitted application materials.

Article 11 (Approval Procedure)

The evaluation team will be responsible for entrusting intermediary agencies to conduct comprehensive evaluations through expert review and other means, review the evaluation results, publicize the projects to be supported online and consult the opinions of the municipal industry authorities.For projects reviewed and approved by the review team, the Municipal Development and Reform Commission, together with relevant departments, shall issue guidance fund support plans to each district.

Article 12 (Fund Allocation)

After the project approved by the review team, the relevant departments of each district and the project units signed the "Shanghai Service Industry Development Guidance Fund Project Implementation Framework Agreement" and reported to the review team, the Municipal Development and Reform Commission submitted an application for fund allocation to the Municipal Finance Bureau, and the Municipal Finance Bureau will allocate funds in stages in accordance with the relevant provisions on the fiscal fund budget management.After the guidance fund support plan is issued, the first payment will be made, and the first payment will not exceed 40% of the predetermined support amount in principle.After the project construction is completed and passed the acceptance, the remaining funds will be allocated.


Chapter 4  On-site and post-event management of the project

Article 13 (In-process Supervision)

During the implementation of the guidance fund to support the project, the project unit should report the project implementation status to the relevant departments of each district every quarter, including the project construction content and implementation site, project investment, implementation progress, team building, organizational management system, overall operation status of the unit, and the use of the guidance funds.

The relevant departments of each district are responsible for conducting on-site supervision of projects, promoting specific daily management of project implementation, etc., and submit project implementation status, guidance funds usage, etc. to the review team every quarter.

Article 14 (Tracking Service)

(1) For major demonstration projects, relevant departments in each district are responsible for promoting the implementation of specific projects and on-site and post-event supervision, members of the review team and relevant departments participate in the full process management of the project, and jointly promote project construction with each district.For major problems encountered by the project unit in its daily operation, the review team will provide follow-up services and actively coordinate and promote them.

(2) Key projects.Relevant departments of each district are responsible for promoting the implementation of specific projects and on-site and post-event supervision.Strengthen tracking services for supported projects, timely understand project progress, and if major changes occur in project implementation, the relevant situation should be reported to the review team in a timely manner.

Article 15 (Project Acceptance)

After the project is completed, the project unit shall submit an acceptance application to the relevant departments of each district within six months.As responsible departments for project acceptance, the relevant departments of each district should formulate relevant acceptance procedures and methods in accordance with the city's project acceptance management requirements, and conduct acceptance within one year after the project is completed (completion).

Article 16 (Project Change)

If a project supported by the guidance fund occurs in the implementation process, the project unit should promptly submit a change application to the relevant departments of each district and shall not change it without authorization.Relevant departments of each district should submit the relevant materials for project changes to the review team.If one of the following situations occurs, it is considered that a major change has occurred in the project:

(1) The project legal person has changed.

(2) The construction location has been changed.

(3) The main construction content and nature of construction have changed.

(4) Major changes have occurred during the construction period (generally refer to the extension of 1 year or more).

(5) The total investment amount has been reduced by 20% or more.

(6) Important changes to other regulations.

If the amount of the guidance fund support changes in the project changes, the review team shall recover the excess support part of the guidance fund within a time limit.

Article 17 (Project Revocation)

If any of the following circumstances occurs, the relevant departments of each district shall submit an application to the review group office to cancel the guidance fund support project. After the review group is discussed and approved, the review group shall recover the allocated guidance funds within a time limit.

(1) The project implementation conditions have undergone major changes, resulting in the project being unable to continue to be implemented.

(2) The project unit has changed the project construction content and goals without application approval.

(3) The project construction period has expired for 6 months, and no application for acceptance or extension is submitted in a timely manner.

(4) The project cannot be completed on time after two years of delay.

(5) Other circumstances in which the project should be revoked in accordance with the provisions of laws, regulations, rules or normative documents.


Chapter 5  Other matters

Article 18 (Supervision and Management)

Relevant departments in each district should promptly summarize the development of the service industry, the use of guidance funds, project implementation, project acceptance, etc., and form an annual summary report on the use of guidance funds, and submit it to the review team before the end of February each year.

The review team is responsible for conducting a comprehensive evaluation of the annual guidance fund use summary reports of relevant departments in each district, and adjusting the arrangements for the guidance funds for the next year based on the review results.After evaluation, the guidance fund arrangements for the next year will be appropriately adjusted for areas that have performed well or areas that have not met the standards and have poor rectification.

The review team, together with the Municipal Audit Bureau, the Municipal Industry Administration and other departments, supervises, audits and inspects the use of guidance funds and project implementation in accordance with relevant regulations, and entrusts professional institutions to carry out post-evaluation of guidance funds and implements project performance management from time to time.

Article 19 (Administrative Fees)

The review team will place relevant expenses such as assessment, post-evaluation, audit, performance evaluation and other related expenses conducted by the municipal guidance fund project conducted by the government purchasing services.

The district-level guidance fund project preliminary review and evaluation, on-site supervision, acceptance audit and other related expenses will be resolved by district-level finance.

Article 20 (Secution of Responsibility)

The guidance funds must be used exclusively.All projects that have obtained guidance funding support shall not change the main construction content and construction standards without authorization.For acts that violate laws and regulations or relevant disciplines such as fraud, interception, misappropriation, etc., in addition to imposing relevant penalties on the project units and relevant persons in charge in accordance with national regulations, the allocated guidance funds will be recovered within a time limit, and the qualification of the project legal person and the project manager to apply for this special fund within three years will be cancelled.

Article 21 (Credit Management)

The review team carries out credit management for project units.During the project application stage, a trustworthy commitment and credit review system are implemented;Establish a credit information management system to record the project unit’s breach of trust at different stages such as project establishment, implementation, acceptance, and evaluation, and provide it to the municipal public credit information service platform in accordance with relevant regulations;For serious breach of trust or illegal acts such as tax evasion and tax evasion in the past three years, the project legal person and the person in charge will be disqualified from applying for this special fund within three years.


Chapter 6  Appendix

Article 22 (Appendix)

The use of special funds for service trade, service outsourcing, and cultural and creative industries shall be managed in accordance with relevant management measures.

This regulation shall be implemented from April 1, 2018 and shall be valid until December 31, 2022.
